The judge for the preliminary procedure of the Court of B&H, Tatjana Kosović, heard the prosecutor Ćazim Hasanspahić who explained the proposal for ordering custody for Hasan Dupovac and Zijad Mutap.
They are charged with the criminal offenses of organized crime, illegal mediation and aiding the perpetrator after committing criminal offense.
Dupovac told the judge that he was a senior police inspector and that he is in the middle class. Mutap stated that he has a high school diploma and that he supports himself by receiving money from people who live abroad.
- Without a doubt, you will see that the suspects communicated and gave money for purchasing a Renault Clio - says Hasanspahić.
Prosecution witnesses S. D. and A. H. testified and the suspects addressed them with the words, "Nothing will happen to you as far as the police is concerned, just don't commit a murder and purchase a Renault car."
- They were buying evidence. They promised money from private sources to buy the vehicle. That Renault was not used in the proceedings. At the hearing, Mutap did not deny that he inquired about that vehicle because it was for sale. Searches were carried out and phones, CDs, USB sticks were found ... A notebook with notes "Muriz Memić interviews" and "Muriz internally" were found at Mutap's house - says Hasanspahić.
The prosecutor emphasized that an investigation was being conducted against 45 people, and that one witness yesterday asked for protection.
- Witnesses are seeking protection. The investigation will be disrupted. To this day, we do not know how young Dženan was killed - explains Hasanspahić.
The prosecution also claims that a network of people is involved in this case.
- Officials from cantons all the way to the state level are involved in this. The investigation is complex and there are conditions to order custody - says Hasanspahić.
The prosecutor also announced the expansion of the investigation to three more people, which will take place in the next 30 days.
Ermin Gačanović, Dupovac's lawyer, expressed concerns, because he believes that the prosecution is abusing institutions.
- Out of 83 pieces of evidence from the proposal, the defense received only 21. The right to defense was violated here. My client has already been a suspect once and that investigation is over - says Gačanović.
He considers his client an honorable police officer who did his job according to the regulations and about whom he says: "If everything happened from the start again, my client would act identically." Lawyer Gačanović also emphasized that he believes that the investigation is politically motivated, but he did not want to explain why.
Mutap's lawyer, Nina Kisić, also objected ordering detention, stating that her client had previously offered the exempted notebook to the prosecution in order to assist in the investigation.
