The director of the Intelligence and Security Agency (ISA) of B&H, Osman Mehmedagić Osmica, fulfilled the conditions four months ago to be retired by force of law, the "Avaz" portal reveals.
According to the information from "Avaz" and the documentation we had at our disposal, Mehmedagić already has 40 years, four months and 13 days of work experience (including benefited work experience), officially registered with the Federal Institute for Pension and Disability Insurance (PIO / MIO).
The Law on Work in the Institutions of B&H specified that employment by force of law ends when the employee completes 40 years of insurance experience, regardless of age.
Illegal benefit
This means that Bakir's director of ISA should have retired four months ago and officially notified the Federal Institute for Pension and Disability Insurance about this.
More precisely, the professional services of ISA were obliged to submit a request for the retirement of director Mehmedagić at the moment he fulfiled 40 years of service, but this, apparently, was not done. In that way, Mehmedagić gained an illegal property gain of almost 20,000 KM during these four months, as long as he is the head of ISA as a pensioner.
This behavior of the director of ISA is also the reason for a new investigation by the Prosecutor's Office of B&H, which is already checking him for a suspicious diploma and abuse of position in the "Security Checks" affair. The job for the Prosecutor's Office is also to find out who enabled him to illegally, after 40 years of work experience, receive a salary of almost 5,000 KM and knowingly abuse his duty. At the end of last year, he earned 58,894 KM in the name of salary for a year.
Documents from the Federal Institute for Pension and Disability Insurance (PIO / MIO) reveal that Mehmedagić started working on November 1st, 1984. in the then Republic Secretariat for Internal Affairs of B&H, where he remained until April 1992.
What Bakir Izetbegović says
He got a job at the Research and Documentation Agency (AID) in December 1995, where he worked until August 2002, after which he transferred to the Intelligence and Security Agency.
Officially, on November 15th, 2015, he was appointed to the four-year term as the director of ISA, which expired in 2019. During that time, he did not have a valid diploma in this position, and a few months ago he was left without access to classified information, because criminal proceedings and three investigations are being conducted against him.
However, for Bakir Izetbegović, his political and dynastic boss, the laws obviously do not apply. He said last week, as a guest on NTV Igman:
- Mehmedagić will remain the director and he will not be dismissed while I am here.
The question now remains whether the political position and patronage of Bakir Izetbegović will be more respected in the application of clear legal provisions, or what the Law on Labor in the Institutions of B&H says and which applies to all citizens of this country.
Will Nikšić start doing his job
After this information, the question is what Nermin Nikšić, the president of the Commission for Supervision of the Work of ISA, will do. The session of this Commission, which is in charge of checking whether Mehmedagić meets the conditions to get a new mandate, has not been held for four months.
Nikšić discussed the unblocking of the Commission's work in early March with Zoran Tegeltija, chairman of the Council of Ministers and head of the Intelligence Body, which oversees the work of the ISA, but the procedure was never completed.
Since then, no Joint Session has been held, nor have members of the Commission met.
Did Tegeltija, Turković and Bevanda know about the conditions for retirement?
These shocking data are also an alarm for the members of the Reporting and Intelligence Body, which is superior to ISA, and which is headed by Zoran Tegeltija. His deputies are Vjekoslav Bevanda and Bisera Turković, which proposed on behalf of the SDA that Mehmedagić's term is extended.
The question now is, which members knew that Mehmedagić is a pensioner and how he was proposed for this position, if it is known that he has acquired all the conditions for retirement.
He only finished primary school?
The data of the Prosecutor's Office, which are in the possession of "Avaz", reveal that, when it comes to Mehmedagić's education, the only indisputable document for now is the one from primary school. Namely, the High School for Electricians, which he allegedly graduated from, was a certified photocopy in the Municipality of Centar in 1994, but it is a duplicate of the diploma.
It was determined that he enrolled at the Faculty of Law without a high school diploma, only with three finished grades. The faculty he enrolled in Banja Luka enrolled with a forged index. In addition, he was found to have forged a diploma from the American University in Sarajevo. Because of all this, he is threatened with a new indictment.
